What Are Counterfeit Products?

Counterfeit products are goods that are falsely branded or intentionally misrepresented as authentic, usually infringing on registered trademarks. This includes:

  • Items with fake logos
  • Unauthorized replicas
  • Packaging designed to deceive customers

Why It’s Serious

Selling counterfeit goods is illegal and damages customer trust. It may also expose you, the seller, to legal action from affected brands and authorities.

Consequences for non-compliance include:

  • Immediate product removal
  • Account suspension or termination
  • Legal action by rights holders or regulatory bodies
  • Sellers could face imprisonment for repeatedly selling fake goods (up to 5 years) and a fine of R10,000 per item sold

How to Avoid Listing Counterfeit Products

1. Source Responsibly

  • Only procure products from authorized, legitimate distributors or manufacturers
  • Keep valid invoices and supply chain documentation on file

2. Use Accurate Product Information

  • Do not use brand names, logos, or images unless you are officially authorized to do so
  • Avoid vague or misleading descriptions that imply authenticity if the product is generic or unbranded

3. Stay Up to Date

  • Familiarize yourself with regulations about Intellectual Property (IP) laws and Product Authenticity
  • Check the Prohibited and Restricted Product List regularly

Documentation You May Be Asked to Provide

  • Purchase invoices from authorized suppliers
  • Brand authorization letters or distribution agreements
  • Product packaging and labeling photos
  • Import permits or certifications, where applicable

Please retain this documentation in case of an audit or investigation. Failure to provide it when requested may result in enforcement action on your account.
